Assessment for a mandate in case of incapacity

In whatever form it may take, a mandate of incapacity is enforceable only after being homologated or approved-by a legal court; in other terms, once it has been examined by a court clerk or by the Superior Court in the legal district where the principal resides.

Psychosocial assessment required

Only the mandatory can request the court for homologation of a document. The request has to join medical and psychosocial evaluation reports establishing the inability of the principal.These assessments have to be executed by professionals.
